What these terms cover

These terms apply to your use of Jatkuu, a habit tracker for couples and small groups, operated by a private individual in Germany (full provider details are published before the public launch) (“we”). By using Jatkuu you agree to them. If you do not agree, please do not use Jatkuu.

A free service for personal use

Jatkuu is free of charge. It is meant for personal, non-commercial use by you and the people you invite into a room. You may not resell Jatkuu, offer it as part of another service, or use automated tools to load or scrape it.

Jatkuu is not directed at persons under 16 years of age. You confirm that you are at least 16 years old.

Your identity and recovery phrase

Jatkuu has no accounts or passwords. Your identity is a key pair on your device, backed up by a 12 word recovery phrase. You are responsible for keeping that phrase safe. If you lose it and your device, we cannot restore your identity or its history, because we never hold the phrase or the private key.

Rooms and sharing

A room is a private space shared with the people you invite. Every member of a room can see everything in it: names, habits, check-ins, moods, reasons, pings and reactions. Anyone who has the room link can join. You are responsible for whom you share a link with. If a link has reached someone it should not have, create a new room and stop using the old one.

The person who creates a room is its admin and can remove members and delete the room. Room admins are expected to use those powers considerately.

Acceptable use

When using Jatkuu you agree not to:

• Harass, threaten, stalk or pressure another member, including through repeated pings
• Enter unlawful, defamatory, discriminatory or otherwise abusive content in names, habit titles, reasons, pings or any other field
• Join a room you were not invited to, or try to guess room links or codes
• Interfere with the service, for example by flooding it with requests, probing it for vulnerabilities without permission, or circumventing rate limits
• Use Jatkuu to collect data about other people without their knowledge

Your content

Everything you enter in Jatkuu stays yours. You grant us only the technical rights needed to store it, sync it to the other members of your room and show it back to you. You are responsible for what you enter and for having the right to share it with your room.

Availability and warranty

We provide Jatkuu as it is, without any warranty. We work hard to keep it available and to keep your data safe, but we cannot promise that Jatkuu will always work without interruption or error, or that stored data will never be lost. Please use the export feature in Settings if you want your own copy.

We may change, pause or discontinue Jatkuu or parts of it at any time. If we shut Jatkuu down entirely we will give you at least 30 days notice inside Jatkuu so you can export your data.

Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and in all cases where liability cannot be limited by law. Since Jatkuu is provided free of charge, any further liability is excluded to the extent permitted by law.

Suspension of abusive rooms

If a room or member violates these terms, we may block the member, suspend the room or delete it, with or without notice depending on the severity. Where we can, we tell you beforehand and give you a chance to export your data.

Termination

You can stop using Jatkuu at any time. To end the agreement, delete your data in Settings (“Delete my data in this room” for a single room, or “Delete room” as admin). Removing Jatkuu from your device alone does not delete data stored in a room; please use the Settings actions for that.

Changes to these terms

We may update these terms when Jatkuu changes or the law requires it. We announce substantial changes inside Jatkuu at least 14 days before they take effect. If you keep using Jatkuu after that, the new terms apply. If you do not agree, delete your data as described above.

Governing law

These terms are governed by the law of the Federal Republic of Germany. If you are a consumer living in another EU country, mandatory consumer protection rules of that country still apply to you.

Severability

If a provision of these terms is or becomes invalid, the remaining provisions stay in force. The invalid provision is replaced by the legal rule that comes closest to its purpose.
